Terms of Sale

Note: The following is a translation of the original French general terms and conditions of sale, and is provided for the convenience of English-speaking readers. In the event of litigation, the French original alone shall be considered binding.
 

Article 1: Application and Scope of the Terms of Sale

These general terms and conditions of sale govern the contractual relationship between EURL TOP SELLERIE (hereinafter referred to as “we”), located at 1, rue du Cours – 61500 SÉES – FRANCE (RCS Alençon 413 768 136), and the person placing any order (hereinafter referred to as “you”) via the website www.topsellerie.com.

These general terms and conditions of sale are systematically brought to the attention of each buyer to allow them to place an order. Therefore, confirming your order on www.topsellerie.com constitutes full and unconditional acceptance of these terms and conditions of sale in their entirety.

Any condition contrary to these general terms and conditions that you may propose will be rejected, unless we have expressly and in writing acknowledged its applicability. We reserve the right to modify these general terms and conditions at any time, provided such modifications are displayed on our website.

 

Article 2: Orders

We commit to accepting your order in accordance with these general terms and conditions.

Please note that we will fulfill your order subject to available stock or availability from our suppliers.

At the time of your order, we inform you of the availability of the products you wish to purchase. Nevertheless, should the products become temporarily unavailable after your order (e.g., out of stock, supply shortages), we will notify you by email and invite you to cancel or amend your order.

If the products become permanently unavailable after the order, we will automatically cancel your order and notify you by email.

By confirming your order, you accept all the provisions of these general terms and conditions as made available on the website and acknowledge having full knowledge thereof. Placing an order implies acceptance of these terms.

Any modification to an order already in production will incur a charge of €150 for a standard configuration (black seat and colored piping) or €200 for a highly customized configuration (multiple colors and/or embroidery).

 

Article 3: Prices

Prices shown in euros are inclusive of all taxes (except for non-EU countries), but exclude customs duties.

We reserve the right to modify our prices at any time, but we commit to applying the prices in effect at the time of your order. All prices are listed in euros.

 

Article 4: Payment

The price is payable immediately upon ordering. Payment is made by credit card or via a PayPal account previously held or created at the time of the order.

Credit cards issued by banks outside France must be international credit cards.
Card payments are secured via the PAYBOX service. Your banking information is handled directly by PAYBOX and is never accessible to EURL TOP SELLERIE.

 

Article 5: Delivery

Unless otherwise agreed, delivery is made to the shipping address provided by you when placing your order.
Goods are shipped at your own risk.

If the package is damaged, it is your responsibility to note this with the delivery driver upon receipt.

In accordance with Article L.121-20-3 of the French Consumer Code, we commit to fulfilling your order within 30 days following the confirmation of payment, unless otherwise agreed with you in advance.

If you choose to send your original seat for customization, processing will begin only upon its receipt, and delivery times will be calculated from that date.
 

Article 6: Products

All our products are systematically branded Top Sellerie, hot-stamped on seats, embroidered on tank covers and bags, screen-printed on scooter aprons.

Any changes to the product (e.g., discontinued material, removed embroidery) cannot be contested if clearly stated on the homepage of our website.

 

Article 7: Returns and Refunds

According to Article L.121-20 of the French Consumer Code, you have 14 days to exercise your right of withdrawal without giving any reason and without penalty, except for the cost of return shipping.

This period may be waived in emergencies (e.g., if you are unable to travel and require an immediate service essential to your living conditions).

This 14-day period starts upon receipt of the goods. Return costs are at your expense, unless the return is due to an error on our part.

Only products that are complete, in good condition, and in their original packaging (along with the invoice number) may be returned or exchanged.

Customized seats made to your specifications via the configurator cannot be returned if they do not meet your personal taste.

In all other cases, products must be returned to:
TOP SELLERIE – 1, rue du Cours – 61500 SÉES – FRANCE.
After this period, the delivered products are deemed compliant with your order and accepted by you.

 

Article 8: Retention of Title Clause

Delivered goods remain our property until full payment of all sums due, including any applicable interest.

This retention of title does not affect the transfer of risk, which takes place once the products leave our premises (see Article 5).

 

Article 9: Guarantee against Hidden Defects and Liability

If the products delivered have a hidden defect, we may, at our discretion, correct the defect or replace the defective product.
If this is not possible, you may return the product for a refund or price reduction.

Products offered comply with French legislation.
We accept no responsibility if the product does not comply with the laws of the delivery country.

We are also not liable for the content of external sites linked from our website.

We undertake to apply all standard professional care in providing our services. However, we cannot be held responsible for a failure to meet our contractual obligations in cases of force majeure (natural disasters, fires, floods, wars, riots, strikes, accidents, supply shortages, etc.).

 

Article 10: Privacy and Personal Information Protection

We are committed to protecting your personal data.
All personal data collected is handled with strict confidentiality, in line with our privacy policy.

We only request the essential information needed to ensure proper order processing and service quality.
We do not sell, rent, or trade this data to third parties.

In accordance with Article 27 of the French Data Protection Act of January 6, 1978, you have a right to access and rectify your data.

By accepting these terms and conditions, you acknowledge having read our privacy policy and consent to the collection and use of your data.

 

Article 11: Applicable Law and Competent Jurisdiction

These terms and conditions are governed by French law and the Vienna Convention on Contracts for the International Sale of Goods, excluding the UN Sales Law (CISG).

All disputes related to the commercial relationship between you and us fall under the exclusive jurisdiction of the French courts, unless you reside outside France and request otherwise.
